Grunnloven § 112 og Klimadommen: En analyse av rettstilstanden i lys av klimadommen

Abstract

Den overordnede problemstillingen er: Hvordan var rettstilstanden med hensyn til håndteringen av klimautfordringene tidligere, og har klimadommen medført en endring i rettstilstanden? Problemstillingen er sammensatt av tre ledd. Det første underspørsmålet: Hva var den rettslige situasjonen for håndtering av klimautfordringer før klimadommen. Andre del i prosjektet redegjør for og analyserer innholdet til klimadommen, for å besvare: Hvordan Høyesterett anvender jussen til å fastslå gjeldende rett. Ved å redegjøre for og analysere innholdet i dommen, åpnes det opp for det tredje forskningsspørsmålet: Har det skjedd en endring i rettstilstanden, før dommen ble avsagt, når det gjelder håndtering av klimautfordringer.

The Overarching problem is: What was the state of the law with regard to the handling of climate challenges in the past, and has the climate judgment led to a change in the state of the law? The problem is composed of three parts. The first sub-question: What was the legal situation for handling climate challenges before the climate judgement. The second part of the project explains and analyzes the content of the climate judgment, in order to answer: How the Supreme Court applies the law to determine the applicable law. Explaining and analyzing the content of the judgment, makes it possible to answer the third research question: Has there been a change in the state of the law regarding the handling of climate challenges.
